Eligibility

Service is applicable only to vehicles registered under the plan.

Membership Validity

The RSA membership is valid for the duration as mentioned in the plan.

Service Limitations

  • Towing is covered up to 50km (up & down). Beyond 50 km, an additional charge of Rs. 50 per km will be charged.
  • Services are limited to the number of incidents as per the plan selected.
  • Hydra crane, accidental recovery, or winching services are chargeable as per actual.

Turnaround Time (TAT)

TAT for providing services will range between:

  • 30-45 minutes: Within city municipal limits
  • 60-90 minutes: Outside city municipal limits or Highway
  • 90-120 minutes: Hilly Areas

Our services are in PAN India except Leh Ladakh, Andaman & Nicobar Island, extreme hilly areas, peace disturbed areas & remote locations.

Terms & Conditions

This End–User Services Agreement (“Agreement”) is an agreement between you, an individual or an individual acting on behalf of your employer, a corporation, partnership, or other legal entity (hereinafter referred to as the “User”) who will be using Crossroads (A Unit of Roadside Awareness Private Limited)(A Unit of Roadside Awareness Private Limited) (hereinafter referred to as “the Company”).

1. Acknowledgment and Acceptance of Agreement

The services provided by the Company are offered to the User in accordance with the terms and conditions set forth in this Agreement, including any amendments, operating rules, or policies that may be published by the Company from time to time, all of which are hereby incorporated by reference. This Agreement constitutes the entire understanding between the User and the Company and supersedes all prior agreements or understandings related to the subject matter herein.

2. Regarding Services

The Company does not currently charge the User for the Services (though it may choose to do so at any time in the future), but it may charge additional fees for any enhancements or premium features the User elects to obtain. The Company reserves the right to modify or discontinue the Services, temporarily or permanently, with or without prior notice to the User. The User agrees that the Company shall not be liable to the User or any third party for any modification, suspension, or discontinuation of the Services.

3. User's Registration Obligations

The User must be at least eighteen (18) years of age to register for the Services. In consideration for the use of the Services, the User agrees to:

  • Provide true, accurate, current, and complete information about themselves as prompted by the registration form
  • Maintain and promptly update such information to ensure it remains true, accurate, current, and complete

If any information provided by the User ("Registration Data") is found to be untrue, inaccurate, outdated, or incomplete, the Company reserves the right to terminate the User's account and to refuse any current or future use of the Services.

4. Use of Registration Data

The User acknowledges that the Registration Data will be stored by the Company. The Company agrees not to contact the User if the User has expressly informed the Company of their preference not to be contacted. The Company shall make reasonable efforts to prevent third parties from contacting the User.

5. Communication to Users

Crossroads (a unit of Roadside Awareness Private Limited) may communicate with its registered users or members through promotional or transactional emails, SMS messages, or phone calls to share information regarding its services, renewals, and promotional offers from its partners and alliances.

6. User Conduct

The User agrees to abide by all applicable local, state, and national laws and regulations while using the Services, and further agrees not to interfere with the use or enjoyment of the Services by other users. The User shall be solely responsible for the content of their private and public communications, whether uploaded, posted, emailed, or otherwise transmitted through the Services, and shall be liable for all such communications.

The User agrees:

  • Not to use the Services for any unlawful purpose
  • Not to interfere with or disrupt the Services, or the servers or networks connected to the Services
  • To comply with all requirements, procedures, policies, and regulations of networks connected to the Services
  • Not to resell the Services or any part thereof, including access to or use of the Services
  • To comply with all applicable laws governing the transmission of technical data exported from India

The User further agrees not to upload, post, email, or otherwise transmit through the Services:

  • Any unlawful, harassing, invasive of privacy, abusive, threatening, harmful, vulgar, obscene, indecent, tortious, or otherwise objectionable material of any kind
  • Any material that infringes or violates the rights of others, including but not limited to intellectual property rights
  • Any material that violates any applicable local, state, national, or international law or regulation
  • Any unsolicited or unauthorized advertisements, promotional materials, junk mail, spam, chain letters, or other forms of solicitation

The User agrees not to attempt to gain unauthorized access to any other computer systems or networks connected to the Services. The User acknowledges and agrees that the Company may, at its sole discretion, ban the User from future use of the Services in the event of non-compliance with the Company's standards of conduct. Furthermore, the User acknowledges and agrees that the Company reserves the right to recover damages from the User for any losses incurred as a result of such non-compliance.

7. Indemnity

The User agrees to indemnify, defend, and hold harmless the Company, its third-party service providers, and their respective parent companies, subsidiaries, affiliates, officers, directors, and employees from and against any and all claims, demands, actions, liabilities, losses, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with the User's use of the Services, connection to the Services, violation of this Agreement, or infringement of any rights of any third party.

8. Storage of Communications

The Company assumes no responsibility or liability for the deletion, loss, or failure to store any email messages, communications, or other content maintained or transmitted through the Services. The Company may, at its sole discretion, establish limits on the amount of storage available to the User for such content.

9. Termination

The User agrees that the Company may terminate the User's password, account, or use of the Services if the Company believes:

  • That the User has violated or acted inconsistently with the letter or spirit of this Agreement
  • That the User has violated the rights of the Company, its third-party service providers, or other users or parties

10. Links

The services may provide, or users may include in emails or community postings, links to other websites or resources. However, the User agrees not to include in emails or community postings (or elsewhere via the Services) any "deep link" leading to a webpage other than the home page of another party's website unless such a link is authorized by the owner of that website. The User acknowledges and agrees that the Company is not responsible for the availability of such external sites or resources, or for the User's use of deep links, and that the Company does not endorse and is not responsible or liable for any content, advertising, products, or other materials available on or from such sites or resources.

11. Company's Proprietary Rights

The User acknowledges and agrees that content, including but not limited to text, software, music, sound, photographs, graphics, video, or other material contained in sponsor advertisements or information presented through the Services or third-party advertisers, is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. The User agrees that such material may only be used as expressly authorized by the Company or advertisers, as applicable, and may not be copied, reproduced, transmitted, distributed, or used to create derivative works without such express authorization.

12. Disclaimer of Warranties

The User expressly agrees that the use of the Services is at the User's sole risk. The Services are provided on an "as is" and "as available" basis. The Company expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The disclaimers detailed on the website shall be read as part of this Agreement.

The Company makes no warranty that the Services will meet the User's requirements or that the Services will be uninterrupted, timely, secure, or error-free; nor does the Company make any warranty as to the results obtained from the use of the Services or the accuracy or reliability of any information obtained through the Services.

The User understands and agrees that any information, content, data, or other material downloaded or otherwise obtained through the Services is obtained at the User's own discretion and risk, and the User will be solely responsible for any damage to their computer system or loss of data resulting from such downloads.

The Company makes no warranty regarding any goods or services purchased or obtained through the Services or any transactions entered into through the Services.

No advice or information, whether oral or written, obtained by the User from the Company or through the Services, shall create any warranty not expressly stated herein.

13. Limitation of Liability

The User agrees that the Company and its third-party service providers shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Services, including but not limited to damages for loss of profits, use, data, or other intangibles, even if the Company has been advised of the possibility of such damages.

The User further agrees that the Company and its third-party service providers shall not be liable for any damages arising from interruption, suspension, or termination of the Services, whether such interruption, suspension, or termination was justified or not.

The User acknowledges and agrees that in no event shall the Company be liable for any damages, whether in contract or tort, including but not limited to direct, indirect, incidental, or consequential damages, or lost profits arising out of compliance or attempts to comply with applicable law.

In no event shall the Company be liable for any and all matters relating to this Agreement for any aggregate amount in excess of the amount paid by the User as per the service plan taken.

In the event that the Company is unable to provide services due to reasons beyond its control, including but not limited to force majeure events, infrastructure failure, third-party dependency, or government restrictions, the Company shall not be held responsible for any compensation, loss, or damages exceeding the total amount paid by the User to the Company.

14. Amendment

The Company may modify this Agreement at any time, and such modifications shall be effective immediately upon posting. Continued access or use of the Services shall be deemed to constitute the User's conclusive acceptance of the modified Agreement.

15. General

The Company's third-party service providers are intended beneficiaries of this Agreement. This Agreement and the relationship between the User and the Company shall be governed by the laws of India without regard to its conflict of law provisions. The User and the Company agree to submit to the personal and exclusive jurisdiction of the courts located within Delhi.

The failure of the Company or its third-party service providers to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the remaining provisions of this Agreement shall remain in full force and effect.

The User agrees that any claim or cause of action arising out of or related to the use of the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

16. Activation

Payment made via online mode will be activated immediately upon successful purchase through our website or any other authorized source. For cheque payments, the services will be activated after successful realization of the cheque, which may take approximately 4–6 working days.

17. Special Exclusions

The scenarios that have special exclusions under prevailing conditions are as follows:

  • "Roads" hereinafter refer to the main roads of the city selected by the subscriber and do not include interior roads of any colony or service lanes. Consequently, customers will not be entitled to free service in case of delays exceeding the following time limits for complaints on such roads: 30-45 minutes (Within city municipal limits), 60-90 minutes (Outside city municipal limits or Highway), 90-120 minutes (Hilly Areas)
  • Services are not applicable in motor racing, rallies, speed or duration tests, practice runs, or operations outside official roads.
  • Any kind of force majeure situation is excluded
  • In case of an accident, services will not be provided, and the Company shall not be held responsible for the non-provision of such services.
  • Breakdowns caused by deliberate damage, vandalism, or participation in a criminal act or offense are excluded.
  • Immobilization resulting from damage caused by intervention of police or other authorities is excluded.
  • Vehicles kept in a non-roadworthy condition or not serviced in accordance with the manufacturer's recommendations are excluded.
  • Benefits (towing, roadside repair, and fuel supply) may vary based on different product offerings.
  • Helpline services are for the vehicle and not for the person.
  • Helpline service is available within the municipal limits of the city/cities listed under this service contract.
  • "Pan India" or "National coverage" means services are available across all cities and highways as listed on our website. However, the Company reserves the right to discontinue services in any city or highway without prior intimation. Registered clients shall have no claim thereto.
  • Deals and discounts offered by garages and other partners are for promotion of their respective brands. Company does not guarantee the quality of service and is not responsible for any claims and/or damages arising from availing these offers and deals.
  • Towing shall be provided by cranes, and the charges for the same shall be borne by the client as per actual.
  • It is mandatory for the customer to produce membership details to avail of the services. If the vehicle is repairable on the road, towing/dropping will not be provided. Towing shall be provided to the nearest service station by our service vans only to vehicles that are easily towable, at market price.
  • For heavy vehicles, towing shall be provided by crane at additional cost, at rates agreed upon by the clients.
  • Fuel up to five (5) litres at actual cost will be provided in case of emergency. Fuel rate is subject to local city rates and availability. CNG and other gases/octane fuel are not provided under this service agreement.
  • Tube or tubeless tyre repair services shall be provided at actual cost depending on the number of punctures. The per-puncture repair cost is variable and depends on the area. Service charges will also be payable as per market price.
  • In case of misuse of services, non-payment of service charges, or misbehavior, helpline services may be cancelled or stopped without prior notice. The Company reserves the right to do so without prior intimation.
  • The Company is authorized to add or change any or all terms and conditions at its discretion at any time without prior notice.
  • The Company shall not be liable for any claims or refunds whatsoever. In rare and extreme cases, any claims shall not exceed the residual value on a per-day prorated basis of the registration period of the service fees paid by the customer. The damages or claims, if any, shall not exceed the amount paid by the user as per the service plan taken.
  • The customer or their representative will have no claim against the Company or its representatives, whether civil, financial, or criminal in nature, pursuant to this helpline service in respect of death or injury of the customer or any other person, or loss or damage to any property caused by or due to equipment failure, negligence, breakdown, accident, or fire during utilization of services or while the vehicle is under repair by the Company's representatives.
  • The Company reserves the right to file a claim or suit against any party/person/company whose cheque is dishonored for any reason. Membership will be activated only after additional payment towards cheque bounce charges.
  • One membership is valid for one vehicle only.
  • All disputes are subject to the jurisdiction of Delhi only.

Data Privacy and Protection

Purpose of Data Collection

Crossroads (A Unit of Roadside Awareness Private Limited) ("the Company") collects and processes personal information such as name, contact details, vehicle registration number, and payment details solely for the purpose of providing Roadside Assistance (RSA) services, verifying membership, ensuring timely support, and improving service quality.

Lawful Processing

All personal data is collected and processed in accordance with the provisions of the Digital Personal Data Protection Act, 2023 and applicable Indian data protection laws. The Company shall process your data only with your consent or as necessary for the performance of services under this agreement.

Data Storage & Retention

Your data will be securely stored on protected servers located within India. The Company retains personal data only for as long as necessary to fulfil service obligations, resolve disputes, or comply with legal or regulatory requirements. Once the retention period expires, data is permanently deleted or anonymized.

Data Sharing

Personal data may be shared with authorized third-party service partners (such as towing operators, mechanics, or call center vendors) strictly on a need-to-know basis to provide the requested services. Such partners are contractually bound to maintain confidentiality and use the data only for fulfilling service requests.

User Rights

Under the DPDP Act, users have the right to:

  • Access and obtain a copy of their personal data held by the Company
  • Request correction or deletion of inaccurate or obsolete data
  • Withdraw consent for non-essential communication (such as marketing promotions)
  • Lodge complaints related to misuse or unauthorized disclosure of data

Any such requests can be made by contacting care@crossroadshelpline.com. The Company will respond within a reasonable time as per applicable law.

Data Security

The Company implements reasonable technical and organizational security measures, including encryption, access control, and audit logs, to safeguard personal data against unauthorized access, alteration, disclosure, or destruction.

Third-Party Links

The Company's website or communication may contain links to third-party websites. The Company is not responsible for the privacy practices or content of such external sites, and users are advised to review their respective privacy policies before sharing any personal information.

Policy Updates

The Company reserves the right to modify this Data Privacy & Protection Policy from time to time. Any updates will be posted on the Company's website or communicated through registered channels. Continued use of services after such updates constitutes acceptance of the revised policy.
